Terms and Conditions
The following Terms and Conditions govern the contractual relationship between Finditly Solutions UG (haftungsbeschränkt) (hereinafter "Finditly" or "we") and you as a user of our platform and services. Full contact details can be found in the Imprint.
§ 1 Scope of Application
These Terms and Conditions apply to all contracts regarding the use of the Finditly platform (accessible at findit.ly), including the creation of business pages, the use of templates, and all related services. By registering for or using our services, you agree to these Terms and Conditions.
§ 2 Description of Services
Finditly provides a SaaS platform for creating and managing online presences for hospitality businesses and other companies. Our services include:
- Provision of a website builder for creating professional business pages
- Access to a template library with customizable designs
- Hosting of created pages under a findit.ly URL (e.g., findit.ly/yourbusiness)
- Analytics dashboard for evaluating visitor numbers and page views
- Management of business information such as menus, opening hours, and contact details
§ 3 User Obligations
As a user, you agree to:
- Provide truthful and complete information during registration
- Only upload content for which you hold the necessary rights (particularly copyrights, trademark rights, personality rights)
- Not publish any unlawful, offensive, discriminatory, or harmful content
- Keep your login credentials confidential and not share them with third parties
- Make due payments on time
- Notify Finditly immediately if you become aware of any misuse of your account
§ 4 Registration and Account
Registration is required to use our services. You must be at least 18 years old or have the consent of a legal guardian. Registration is free. You are responsible for all activities that occur under your account. We reserve the right to temporarily suspend or permanently delete accounts in case of suspected misuse or violation of these Terms and Conditions.
§ 5 Prices and Payment
- Starter Plan: Free with basic features. Created pages include a reference to Finditly.
- Pro Plan and Business Plan: Paid subscriptions with extended features according to the current price list on our website.
- All prices include applicable VAT.
- Payment is made via credit card, PayPal, or Revolut Pay. The invoice amount is charged in advance for the selected billing period (monthly or annually).
- In case of payment default, we reserve the right to suspend access to paid features.
§ 6 User Content (User Generated Content)
Definition: "User Content" refers to all content you upload or create on the platform, including texts, descriptions, images, logos, menus, opening hours, contact details, and other information about your business.
Your Rights: You retain all rights to your User Content. By uploading, you grant Finditly a simple, worldwide, royalty-free license to display, store, and process this content within the platform. This license is limited to the contract duration and serves exclusively to provide our services.
Public Visibility: You understand and accept that your created business page and the User Content published on it are publicly accessible on the internet. You should not publish sensitive personal data that is not intended for the public.
Your Responsibility: You are solely responsible for all User Content you publish. You warrant that your content does not infringe any third-party rights (particularly copyrights, trademark rights, personality rights), is truthful and not misleading, and does not contain any unlawful, offensive, or harmful content.
Indemnification: You indemnify Finditly against all third-party claims arising from the infringement of rights through your User Content, including reasonable legal fees.
Moderation: We reserve the right to remove User Content or restrict access without prior notice if it violates these Terms and Conditions or applicable law, or if we are notified of a potential infringement.
§ 7 Platform Rights
All rights to the Finditly platform, templates, design, source code, graphics, and all other materials provided by us remain with Finditly. You receive a simple, non-transferable, non-sublicensable right of use for the duration of your subscription. It is prohibited to copy, decompile, reverse engineer, or use the platform or parts thereof for purposes other than the intended use.
§ 8 Prohibited Use
The following uses are prohibited:
- Publication of content that violates applicable law
- Infringement of copyrights, trademark rights, or other protective rights of third parties
- Distribution of malware, spam, or unsolicited advertising
- Use of the platform for fraudulent or misleading purposes
- Systematic reading or copying of platform content
- Any action that could impair the operation of the platform
§ 9 Availability and Warranty
Availability: We strive for high platform availability but cannot guarantee uninterrupted use. Maintenance work will be announced where possible.
Warranty: The platform is provided "as is". We warrant the agreed functionality according to our service description. No further guarantees or assurances are provided.
Third-Party Services: Integrations with third-party services (e.g., Google Maps, payment providers) are subject to the respective terms of use of these providers.
§ 10 Liability
Finditly is fully liable for damages arising from injury to life, body, or health, as well as for intent and gross negligence. In case of slight negligence, Finditly is only liable for breach of essential contractual obligations (cardinal obligations). Liability in these cases is limited to foreseeable, contract-typical damages. Liability for lost profits, indirect damages, and consequential damages is excluded in cases of slight negligence.
§ 11 Contract Duration and Termination
The contract is concluded for an indefinite period. Paid subscriptions have a minimum term corresponding to the selected billing period. You may cancel at any time effective at the end of the current billing period. Cancellation is made through your user account or by email to support@findit.ly. After contract termination, your content and created page will be deleted. We recommend creating a backup of your data beforehand.
§ 12 Data Protection
The protection of your personal data is important to us. Details on the collection, processing, and use of your data can be found in our Privacy Policy. By using our services, you consent to the data processing described therein.
§ 13 Right of Withdrawal for Consumers
- If you are a consumer within the meaning of applicable law, you have a right of withdrawal.
- You may revoke your contractual declaration within 14 days without giving reasons in text form (e.g., email).
- The period begins upon conclusion of the contract. Timely dispatch of the withdrawal to support@findit.ly is sufficient to meet the deadline.
§ 14 Changes to the Terms and Conditions
We reserve the right to amend these Terms and Conditions with effect for the future. We will inform you of changes at least 30 days before they take effect by email. If you do not object to the changes within 30 days of receiving the notification, the amended Terms and Conditions shall be deemed accepted. We will specifically inform you of this right of objection and the consequences of silence in the notification.

§ 16 Final Provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with this contract is, to the extent permitted by law, Mannheim. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
